Terms And Conditions
1. General
These Terms & Conditions apply to all services provided by the Company (“we”, “our”) to the Customer (“you”).
While we strive for punctuality, we cannot accept responsibility for delays caused by events beyond our control.
Drivers will operate vehicles safely, following legal road rules and speed limits.
Customers are responsible for any damage caused to the vehicle’s interior or exterior while in their use. Repair or valeting costs will be billed accordingly.
Subcontracted vehicles may be used when required.
By providing your email address, you agree to be contacted regarding your booking. Your details will never be shared with third parties.
Any variations to your journey (e.g., extra mileage) may result in additional charges.
We reserve the right to change your vehicle or driver if necessary.
Drivers will take the most suitable route unless otherwise instructed.
Vehicles and subcontracted vehicles are fully insured for passengers and third-party claims. However, we are not responsible for loss or damage to customer property.
2. Safety & Conduct
Drivers may refuse service to passengers under the influence of alcohol, drugs, or whose behaviour poses a risk to others.
Smoking is strictly prohibited in all vehicles.
3. Lost Property
Lost items left in vehicles will be recorded and returned where possible.
4. Invoice Limitations (Account Customers)
Account customers may be given a credit limit. Services may be suspended if this limit is exceeded.
5. Security Account Number
Account customers will be issued a unique security number for bookings.
We are not responsible for unauthorized use of security numbers.
6. Payment & Deposits
All invoices must be paid within 30 days. Late payments may incur 3% interest per month until settled.
Card payments incur a 5% surcharge (non-refundable).
All prices exclude VAT (charged at 12%).
Payment is required at least 7 days before travel.
The first hour of waiting is free, after which waiting is charged at 50.00 Rupees per minute (or £0.25 per minute) plus any car park fees.
Credit card payments will appear as Aavurton Travels & Tours Ltd.
7. Cancellation & Refunds
Cancelling within 24 hours of travel: 40% of the total is non-refundable.
Cancelling within 8 hours of travel: 100% is non-refundable.
Failure to appear at the pickup time/place: no refund, and additional recovery costs may apply.
8. Insurance
We do not insure goods or property in transit. Customers must arrange their own cover if required.
9. Limitations & Exclusions
We will not carry or be liable for:
Money, securities, jewellery, antiques, or items of unusually high value.
Hazardous, illegal, flammable, or perishable goods (unless agreed in writing).
Loss or damage arising from breakdowns, accidents, adverse weather, strikes, riots, war, terrorism, or other events beyond our control.
Loss or damage due to inadequate packaging, incorrect labelling, or wrong instructions.
Indirect or consequential losses, including loss of profit.
Liability for loss or damage is limited to the lesser of:
£100, or
The intrinsic value of the goods/property.
These limitations do not apply to death or personal injury where liability cannot be excluded by law.
10. Delivery
We will make reasonable efforts to deliver the Customer or their goods on time, but time is not guaranteed unless confirmed in writing by a Company Director.
If delivery cannot be made for any reason, we may charge for costs incurred and any storage or return expenses.
11. Claims
Any claim for loss or damage must be made in writing within 15 working days and include full details of the incident.
12. Lien
We reserve the right to retain customer goods until full payment of outstanding invoices is made.
13. Resolution of Disputes & Governing Law
All disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
14. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior discussions or agreements, whether oral or written.
15. Notices
Any notice under this Agreement will be considered served if sent by registered post, recorded delivery, or electronic communication to the address provided.
16. Waiver
Failure by the Company to enforce any right does not constitute a waiver of that right.
17. Severability
If any term in this Agreement is found to be invalid or unenforceable, the remaining terms will continue to be in full effect.
